Court to resume Wind Parks of Ukraine v. Code 21 case in late October
The Commercial Court of Zakarpattia Region will resume hearing on 28 October the case brought by Wind Parks of Ukraine management company LLC against the NGO Code 21 over protection of business reputation. The company seeks a retraction of information spread on Facebook and UAH 50,000 in moral damages.
On 18 September 2026 the court adjourned the hearing in Case No. 907/353/26. The reason was that the parties submitted written explanations right before the hearing, and the court and the other participants had no time to review them. The next hearing is set for 28 October 2026.
What Wind Parks of Ukraine is demanding
The claim concerns a post on the Facebook page Zakarpattia Ekologichne, run by Code 21. The claimant asks the court to declare false the statement that the company would supposedly "destroy" the mountain ridges and the Rivna meadow within the next two years. It also demands that the NGO be obliged to publish a retraction and pay UAH 50,000 in moral damages.
Proceedings were opened in April 2026. In June the court completed the preparatory stage, and the hearing on the merits began on 17 August.
The court requested additional data on wind projects
During the proceedings, the court asked Wind Parks of Ukraine to provide additional explanations and evidence on the company's business reputation, including its wind farm construction activities in Zakarpattia and other regions. The company was also asked to explain its legal ties to the land plots on which wind facilities are being built, as well as to customers and contractors carrying out construction and installation work.
Separately, the court requested information on the results of work already done, wind facilities put into operation, and the current status of projects connected with the Rivna meadow, the Svydovets ridge and the Krasna meadow. For its part, Code 21 was asked to present evidence and explanations regarding the alleged destruction of the natural appearance of these areas.
